Give-and Take: Recipe for Success in Marriage?

By Azriel Winnett A woman once visited a counselor to ask a question about her marriage. I have a funny feeling that you might not be especially impressed with the answer she was given. All the same, I’ll take my chances. I think my shoulders are broad enough. I stand by the counselor’s response 100%. The questioner (let’s call her Jane) was married to a divorcee. Her husband (John) had to pay a certain sum of money every month to his previous wife as alimony, or whatever. Sticky patch He had just started a new business and was passing through a financial sticky patch. The obligation to his ex-wife, on top of everything else, was putting John under a lot of pressure. Jane was a working person and gladly helped to pay the family debts. She never thought twice about it. But could she be expected to contribute in this case? Surely, reasoned Jane, her husband’s financial commitment to somebody to whom he had been married previously had nothing to do with her? Yes, she and John were life partners and she was happy to share all his burdens. But even for what happened in a previous life, so to speak? Wasn’t that going too far? “I must confess I don’t really understand your question,” the counselor gently told Jane after listening intently to her dilemma. “You and John are husband and wife. John has a debt. He’s struggling to pay it. What difference does it make what the debt is for? It’s a debt, period!” The counselor smiled warmly at Jane before she continued. “His problems are your problems. You’re in this together. Why on earth shouldn’t you help pay the debt? If, after all, it’s difficult for you to accept this, it must be that there’s some deeper problem in your marriage…” And that’s it. Don’t hit the roof! Now, it’s important not to misunderstand the counselor, or me. I don’t want your blood pressure to hit the roof! We have to keep cool heads and put everything in the proper perspective. First of all, she wasn’t implying, of course, that John now had a licence to sit back, put his legs up, and meditate blissfully about the higher meaning of life, while his dear and ever obliging spouse worked like a donkey to pay the price of his past. Not at all. I should think that’s pretty obvious, but I have to stress it just in case. Secondly, when we talk about husband and wife being full partners in the business of living, about sharing each other’s burdens - financial or otherwise - no less than each other’s joys, we are not saying for one moment that either party must contribute more than is reasonable. In the case of our story, Jane was a high-earning professional. In other instances, a wife may bring in little or no income, for any of a number of reasons. It may not be desirable that she be working at all. And not only money! But that’s hardly the point. We’re talking of quality, rather than quantity. One can only do what one can, but it’s the real desire to help that counts. And contributing doesn’t only mean money. I’ll let you in on a little secret. I don’t really like the use of the word PARTNER in connection with marriage. True, we’ve used it up to now, for want of a better term. It does come in handy to describe a good marriage relationship, up to a point. Yet, I hardly think that an ideal marriage relationship is a “partnership” in the same sense that we talk about a business partnership, for example. Not at all. When we think of a partnership, we usually think about a contract between two parties. A 50-50 sharing of responsibilities,or the like. Confused? A little confused? Well, let me explain! Do you have children? Good! Do you love them? “What a question!” you exclaim, “Gee, how I love them!” “Don’t you know the sacrifices we made for them? From the moment they came into this world, when they depended on us for their very survival, my spouse and I gave them our all. Just as much as a whimper from them in the middle of the night, and we were there to attend to their needs. Even now, they may disappoint us, anger us or hurt us, but we continue to cater to their every whim…Do you need any greater proof that we love them!” So…is that why you’ve done so much for them - because you love them so much? Wrong way round Could be. But even more, I’d say it’s the other way round: You love them so intensely BECAUSE you’ve done so much for them! This is nothing more or less than human nature, and I think there’s a great lesson for us here. We need to think about this very carefully. Sometimes, when two people begin to think about marrying each other, they think in terms of some business arrangement. Whether they verbally express it that way or not, their minds work something along these lines: “You have needs and I have needs. Maybe, if I satisfy yours, you will satisfy mine. You wash the dishes and I’ll pay the rent. Sundays to Tuesdays I’ll take out the garbage, and for the remainder of the week you will. Other duties will be divided by mutual consent. For every suit I buy, you can buy two pairs of shoes…” If this is the marriage you want, good luck to you! It’s a free world. But will you be happy? I mean, really happy? I wonder. Many people will tell you that for a happy marriage, you need what they describe as “give-and-take”. Give and take? Nonsense! Forget about it! What you need is “give and give.” And give again. Criminal Law: A Critical Analysis of the Magistrate Court

By Thomas Gallagher Introduction The Magistrates Courts play an extremely important role inside the criminal justice system within the United Kingdom. This brief article will assess the functions of the magistrates court and evaluate the effectiveness of having a mechanism for determining the guilt of a defendant based solely on the discretion of the magistrates present. Before assessing the origins of the magistrate court, there will be a brief examination of what a magistrate is and what their functions are. Following from this, a brief insight into the origins of the magistrate court will be given, as it is important to understand the origins of any system as this will inform the reader of the initiative behind the original concept. After discussing the origins of the system, the procedure of appointment will then be discussed. This process will then be examined when the analysis is focused upon the procedures contained within the Magistrate court for assessing the guilt of a defendant. As a defendant will be denied a trail by jury, the system in place for the appointment of these magistrates is of paramount importance, as all individuals must be judged by their peers. If, after considering the evidence, the current system is deemed to be defective, then possible solutions will be considered to improve the present situation. The article will conclude that although the current system is far from perfect, it serves as a significant filter for more serious crimes which are tried in the Crown Court by a jury. What is a Magistrate? In the courts of England and Wales, it is the function of a magistrate to hear prosecutions for summary offences. They have the power to make orders in regard to and placing additional requirements on offenders. Magistrates’ sentencing powers are limited compared to that of the Crown Court (See Criminal Law: A Critical Analysis of the Crown Court), extending to shorter periods of custody, fines, probation and community service orders, and a miscellany of other options. Magistrates hear committal proceedings for indictable offences, and establish whether sufficient evidence exists to pass the case to a higher court for trial and sentencing. Magistrates have power to pass summary offenders to higher courts for sentencing when, in the opinion of the magistrate, a penalty greater than can be given in magistrates court is warranted. The function of a magistrate is of great importance, but where did they originally come from? Origins of the Magistrate Court The origins of the magistrate system can be seen to have been initiated in the 12th century. Richard I (Richard the Lion heart) commissioned certain knights in England to keep the Kings peace in unruly areas. By the 14th century, a new phrase had been coined to describe individuals who had accepted the responsibility of keeping the peace. The title Justices of the Peace was initiated during the reign of Edward III and referred to ‘good and lawful’ men to be appointed in every county to ‘guard the peace. The magistrate system has evolved since its early inception and now deals with over 95% of all prosecuted crime and is responsible for handing out over 336m in financial penalties per year. (Source: Department for Constitutional Affairs [DCA]) If a magistrate is responsible for presiding over certain criminal cases, then there must be a proficient system in place to appoint these individuals. The Appointment Process of Magistrates The Municipal Corporations Act 1835 provided for Justices of the Peace to be nominated by the Lord Chancellor for the boroughs, in consultation with local advisers. The county benches, however, continued to be confirmed by the Lord Chancellor by way of the nomination of the Lord Lieutenants, who had their own methods for finding suitable candidates. The system was inadequate and was challenged by the Liberal Government in 1906 as there were too many conservatives sitting on the benches. Lord Loreburn, as Liberal Lord Chancellor, nominated 7,000 magistrates of whom 3,197 were Liberals. The Royal Commission on the Appointment of Justice of the Peace in 1910 recommended the institution of an Advisory committee system. A year later Advisory Committees on which Liberals and Conservatives were equally represented had been set up in most counties to advise Lord Lieutenants on nominations. A few years later the boroughs had also formed advisory committees. Originally, appointment to these committees was for life, however, in 1925, Lord Cave introduced appointment for 6 years and ordered half the committees to retire by rotation every three years. A magistrate can, however, still remove a persons liberty for criminal offences. If we are all to be judged by our peers, then a magistrate should be just that. The problem is, however, that the appointment process is engineered towards professional people who share very little with the people that they judge. Assessing Guilt in a Magistrate Court As stated above, magistrates will decide on the guilt of a defendant. There will be no trial by jury, therefore, it is essential that the people who sit in judgment are the defendants peers. If one looks at the application process as provided on the department for constitutional affairs, the qualities needed are good character, ability for understanding and communication, social awareness, maturity and a sound temperament, sound judgment and a commitment to the job. These are all admiral qualities, yet these are not imposed upon any jury that sits in judgment of more serious cases. Why is this so? There are numerous possible explanations for this polarized approach, and often depends upon a persons particular ideological persuasion. Nevertheless, the statistics speak for themselves. Most magistrates are white, middle class males. If one considers that defendants should be judged by their peers, it would be interesting to see how white, middle class males go out stealing cars, or indeed committing other petty criminal offences. What are the possible solutions for this problem? A Call for a More Diverse Magistrate Pool Magistrates work on a voluntary basis and need time off work to honor their commitments. There have been Proposals to make it easier for magistrates who are in employment to take time off from work to sit in court (Monday 7 November 2005 10:37 Department for Constitutional Affairs). This, for me, does not solve the problem of having a primarily middle classed system acting as judge, jury and executioner. What is needed is a more diverse magistrate pool. This will provide for a more understanding magistrate. If one has lived in a cozy, secure, insulated world, how are you going to have any affinity with an individual who has had a disrupted childhood? The answer is that you are not. The arguments in favour regarding a more diverse pool of magistrates is deafening, however, it remains to be seen as to whether they will be heard. Conclusion This paper has assessed the role of a magistrate within the judicial process by tracing the origins of the magistrate and looking at the way in which a magistrate is appointed. The role of the magistrate is one that should never be undervalued. They give up their time on a voluntary basis and provide a vital service in filtering the more serious crimes to be tried in front of a jury. There exists a fundamental problem, however, in that a magistrate often shares no life experiences with the people that they sit in judgment over. The sociological implications for a system, such as the one in place cannot be underestimated. The time has now come for a more diverse magistrate pool that draws from all members of society, regardless of their previous background. But while most boaters take the time to ensure that their crafts are in proper working order, many fail to pay attention to a vital piece of boating equipment: the boat trailer. It is estimated that nine out of every 10 trailer malfunctions and accidents are the result of neglect and inadequate preventative trailer maintenance. It’s not that people don’t care whether or not their trailers are in working order; it’s just that boat trailers are not that glamorous, and when put next to the boat itself, they often take a backseat on the maintenance schedule. The truth is that taking proper care of your boat trailer really does not take a whole lot of time and attention. And taking as little as a few minutes each time you get ready to hit the road can save you from disaster. Just think about it this way, a boat trailer is the only thing between your precious boat and the road. Shouldn’t you take a few extra minutes to make sure your boat is safe? Here’s what to check for: Wheels and Suspension. Before taking off, make sure to check your tire pressure and that of the spare tire. Check the lug nuts to make sure they’re tight. Visually inspect the suspension undercarriage for signs of rust, pitting, or cracking. If you see a problem, get it fixed right away or you may find your boat kissing the road. Brakes. Always check these straps for signs of fraying or damage. Having all of these harnesses in proper working order can save your boat from sustaining unnecessary shock during transport. This shock can lead to structural damage. Wheel Bearings. Bearings need to be inspected and greased regularly. Doing so can help you avoid trailer-related malfunctions and allow for an easier tow. Bunks and Rollers. Visually inspect the bunk and roller for scratching and gashing. Check the carpeting for tears and patch or replace when necessary. Also you must grease the rollers occasionally to ensure smooth movement. As you can see it does not take a great deal of time to give a little bit of extra attention to your boat trailer. And doing so can save you a great deal of money, hassles and heartache in the end. Just finding one of these problems and fixing it early can keep you from disaster and just may even save your boat. This shows that both people have realistic expectations. If both people have Heart Lines that end on the Mount of Jupiter, theyll be overly idealistic and have many disappointments. This still indicates compatibility, but the Mental Heart Line shows a more impersonal love and difficulty in expressing innermost thoughts. This partner with the Mental Heart Line would also tend to be a little detached at times. A number of compromises would have to be made by both partners in this relationship. Therapeutic Uses of Honey in Ayurveda

By Dr.Krishna R.S The FAO Codex Alimentarius Commission defines honey as the natural sweet substance produced by honeybees from the nectar of flowers or from secretions coming from living organisms feeding on plants, that bees gather, transform and combine with specific ingredients, store and leave to ripen in the combs of the hive. In Ayurveda honey is called as “Madhu”. Its qualities are explained as follows. Vaatalam guru sheetam cha raktapittakaphapaham |Sandhatru cchedanam ruksham kashayam madhuram madhu || It has sweetness (madhura rasa) with added astringent as end taste (Kashaya anu rasa). It is heavy (guru guna), dry (ruksha) and cold (sheeta). Its effect on doshas is as follows It aggravates vata, scrapes kapha and normalizes pitta and rakta. It promotes healing process. The contents of Honey are 1. Sugars like fructose, glucose, sucrose, maltose, lactose and other disaccharides and trisaccharides. 2. Proteins, fats, vitamins, minerals, enzymes and amino acids, 3. Volatile aromatic substances. 4. Ashes and water etc. Various ingredients of honey have helped it to become not only a sweet liquid but also a natural product with high nutritional and medicinal value. The medicinal quality, taste, texture, color, aroma of honey differs according to the geographical area and the species of plants from which it has been collected. Types of Honey: Eight types of honey are described in ayurveda depending on the type of bee which collects it. They are Pouttika ,Bhramara .Kshoudra, Makshika , Chatra , Arghya ,Oudalaka ,Dala . Pouttika - This honey is collected by very large bees from the nectar of poisonous flowers. It increases vata, causes gout and burning sensation in chest.It is also sedative and reduces fat. Bhramara - This honey is collected by large bees and Sticky in nature. Kshoudra - (Honey collected by medium sized honey bees ) light and cold in nature. Dissolves Kapha. Makshika - (Honey collected by small honey bees) very light and dry natured. Usefull in VataKapha diseases and kapha diseases Chatra - Heavy and cold in nature usefull in gout, Leucoderma (Shwitra), Arghya - Good for eyes but causes arthritis . Oudalaka - Useful in skin diseases, and helps in modulation of voice. Dala - Dry and reduces vomiting. Amongst all the above “Makshika” is considered as the best type with immense medicinal properties. Therapeutic uses of Honey: 1. As it contains sugars which are quickly absorbed by our digestive system and converted into energy, this can be used as instant energizer. 2. As it is hygroscopic it speeds up healing, growth of healing tissue and dries it up. 3. Honey acts as a sedative and is very usefull in bed wetting disorders. 4. Honey is very good antioxident which restores the damaged skin and gives soft, young looks. 5. Honey has antibacterial properties due to its acidic nature and enzymically produced hydrogen peroxide. 6. Constant use of honey strengthens the white blood corpuscles to fight bacteria and viral diseases. In Ashtanga Hridaya the great classic of ayurveda, the therapeutic uses of honey are explained as follows. Chakshushayam Chedi tritshleshmavishahidmaasrapittanut |Mehakushtakrimicchardishwaasakaasaatisaarajit ||Vranashodhana sandhaanaropanam vaatalam madhu || Honey is very good for eyes and eye sight. It quenches thirst. Dissolves kapha. Reduces effects of poison. Stops hiccups. It is very useful in urinary tract disorders, worm infestations, bronchial asthma, cough, diarrhea and nausea -vomiting. Cleanse the wounds. It heals wounds. Helps in quick healing of deep wounds. Initiates growth of healthy granulation tissue. Honey which is newly collected from bee hive increases body weight and is a mild laxative. Honey which is stored and is old helps in metabolism of fat and scrapes Kapha. Ayurveda explains another special quality of honey. Honey is called as Yogavahi . The substance which has a quality of penetrating the deepest tissue is called as Yogavahi. When honey is used with other herbal preparations it enhances the medicinal qualities of those preparations and also helps them to reach the deeper tissues. Precautions to be taken before using honey: Honey should not be mixed with hot foods. Honey should not be heated. Honey should not be consumed when you are working in hot environment where you are exposed to more heat . Honey should never be mixed with rain water, hot and spicy foods, and Fermented beverages like whisky, rum, brandy etc, Ghee and mustard. Honey includes nectar of various flowers of which some may be poisonous. Poison has hot or Ushna qualities. When honey is mixed with hot and spicy foods the poisonous properties get enhanced and cause imbalance of doshas. Few Home remedies with Honey Mix 2 tea spoon of honey with carrot juice and consume regularly. This helps to improve eyesight and is very helpful for those who sit before computer for long hours. In cold, cough and congested chest mix 2 tea spoons of honey with equal quantity of ginger juice and should be consumed frequently. A mixture of black pepper powder, honey and ginger juice in equal quantities, when consumed thrice daily help to relieve the symptoms of asthma. Regular use of one tea spoon of garlic juice mixed with two tea spoons of honey help to control blood pressure. One glass of warm water taken with two tea spoons of honey and 1 tea spoon of lemon juice in early morning reduces fat and purifies blood. Consuming one spoon of honey daily help us to lead a healthy long life. The most basic principle that marriage counseling teaches is to save an existing relationship from total destruction and to lead both of the couple back to the path of marital bliss. Though marriage counseling may work for some, the truth remains to be the truth- there are marriages that may never be saved. For both conditions, there are corresponding reasons and factors. Many of these will be discussed in the succeeding paragraphs. But the bottom line for both factors is that the willingness of both parties to restore the broken relationship is actually the ultimate driving factor. There are several reasons why couples seek marriage counseling. This is but natural, for there are endless possibilities why how people create conflicts in their marriages. Though it is widely accepted that all marriages are bombarded with difficulties some time in their lives, it is sad to note that many don’t seem to override them. And most drop into the pitfall of divorce. The most natural conditions by which marriage counseling is often sought are when couples feel frustration, extreme sadness and severe hurt. These are frequently not new between the couples and had been growing around for years. Unfortunately, the only time that people enter marriage counseling is when the relationship is already on the edge of breaking down. This is reason enough why young couples or those that are yet starting to sense fraction in their relationship have the greater chance of fixing the marriage. It is not wrong to aspire for happiness. But it is not often that way. To get rid of further troubles, it is wise to accept this reality and to work towards achieving happiness on a more sensible and realistic approach. Marriage demands hard work. It obliges the couple to commit themselves to the consequences of their relationship. They often need to suspend their egos and to drop down the claim for who is right to get around the issues that may send them shouting over dinners. Agreeing to drop the “who is right” thing is a crucial part of both the marriage and marriage counseling. Without this, everything may all be in vain. It may have been observed that throughout this article, saving the marriage is only the central discussion. But how about for those couples who insist for divorce? Marriage counseling may also answer for that. However, it may be a much longer process, especially when children are at stake. If the marital relationship may not be saved, then the best solution to this is for the couples to transform into friends or willing co-parents towards the growth of their children. This way, pain may be lessened while contributing to a much constructive process. During the stage of dissolution, extreme pain and other mixes of emotions may be felt. This state may be further aggravated by the obvious emotional and physical separation. For the majority of cases, this state may come to the level of mourning and distress. Marriage counseling may be of best help during this condition as it may help to bring out unexpressed emotions between the couples. Once the signs of marriage destruction have made themselves transparent for the couples, it is best to seek marriage counseling in the earliest possible time. There’s a popular term amongst some circles to improve a man’s ‘inner game’. Taken in my context, that is limited if the man is still ignorant to the relational power game and the disempowering relationships that he is currently in. If a man wanted to skyrocket his own success with women and in life, instead of just focusing on improving himself, he should look at the types of relationships he is in and reframe his relational reality so that he has the freedom to actualize his inner game. Wise sage’s talked about improving oneself and ‘knowing thyself’. Unfortunately today there are other relational elements involved that prevent men from realizing anywhere close to their potential. The sage’s back then didn’t have a social hierarchy of power that repressed the men anywhere near it has conditionally altered their behavior to today. The men were more independent and free in earlier history. Those men didn’t deal with commercial sexploitation and behavioral conditioning. They didn’t deal with unnaturally behaving women either. All of these things today are getting in the way of man actualizing his own potential because he’s stuck in a disempowering position throughout much of his daily life. If men could be aware of their relationship to other sources of power and reframe their reality so that instead of being a conditioned response to a certain stimuli (such as sexploitation or ‘programming’) and instead took an interdependent win/win relationship with other sources of power, then everything would change. They could fully be themselves at all times instead of being invisibly repressed. Then they could have more power, respect, success and attraction in life. So many experts out there will focus on the man’s ‘inner game’ and improving himself. I did that consciously for a decade and it made me a ‘better man’ but I was still limited in many areas because of the power that other sources had over my life in certain relationships. Men without their own awareness, are in disempowering relationships to television, magazines, women, and in many cases money itself. Those are some VERY powerful sources, especially considering that men generally desire women and money the most. If he wants to be effective in those areas, he can improve himself all he wants but if he’s still ignorant to the type of relationship he has with them, he’s quite limited. Know your relationship to other powers out there that have repressed your own inner game in the first place instead of continuing to run into walls. Positive thinking, body language techniques and ‘inner game’ are not enough if you’re still letting someone else have relational authority over you in those relationships. For true behavioral change, relational dynamics is the missing link. Master your relationships and then you’ll have the freedom to master yourself, because by default now, there are others wanting to manipulate and influence you.
